Terms and Conditions
These Terms and Conditions apply to all pages found at www.aqweela.com; www.mathematics.aqweela.com; www.shortcourses.aqweela.com; alevels.aqweela.com; ibdiploma.aqweela.com; sat.aqweela.com; apexams.aqweela.com; ielts.aqweela.com; gre.aqweela.com; gmat.aqweela.com, igcse.aqweela.com, thephysicsandmathtutor.com and all courses operated by Aqweela Education (referred to as “AE”) and its subdomains. These terms apply to all lessons, classes, courses, and options offered by AE (hereinafter referred to individually as “Course” or collectively “Courses”).
By purchasing, using, or allowing your student to use any of AE’s Online Courses, you agree that you and your student will abide by and be bound by these Terms and Conditions. In cases where these Terms and Conditions and AE’s General Terms and Conditions conflict, the terms found herein apply to any AE Online Course or Product.
Privacy Policy: By using AE’s website, registering you or your student for a Course, and/or affirmatively giving your agreement, you are agreeing on your own behalf and that of your student to abide and be bound by the Privacy Policy found at www.aqweela.com/privacy and the Terms and Conditions contained and referenced herein.
I. Code of Conduct
To promote the best learning environment possible, all students and parents/guardians will be held to this Code of Conduct. Failure to comply with this Code of Conduct or engaging in actions or attitudes that seem to be harmful to the atmosphere, other participants, or staff, in the opinion of AE can lead to removal from a Course(s). AE reserves the right to dismiss students from a Course and prevent a student from attending additional courses without any prior warning for
(1) violating any of the terms of this code of conduct, or
(2) if AE determines that a Course is not a suitable and/or productive environment for a student (this includes incidents in which a student does not have sufficient English language skills to participate in the Course; participation in courses requires a high level of English understanding). Refunds will not be given for students dismissed for failure of the student or the parent to abide by the Code of Conduct. However, if it is determined that a Course is not suitable for a student, a refund may be issued. While AE strives to maintain excellent relationships with students, in some rare cases, we may determine that AE is not a compatible environment for every student.
Students and parents/guardians may NEVER:
- Disrupt, bully, intimidate, or harass others;
- Use inappropriate language (for example, students cannot use swear or curse words, racial, gendered, stereotypical, or culturally insensitive words, even if done in a joking manner);
- View, display or post any inappropriate material (including sexual content, material depicting inappropriate violence, racism, bullying, etc.) during a course; and after that, as long as they have access to Blogs
- Share Course information (including lesson plans and study material etc.) with third parties, without prior written permission from AE;
- Impersonate another person;
- Record the lectures, as the AE lectures are copyrighted.
Students also may NEVER:
- Engage in internet hacking;
- Use false information to create an account on or log in to third-party websites;
- Share personal information with staff members or ask staff members for their personal information;
- Share or create video or audio recordings of AE staff or another student.
Students and Parents/Guardians MUST:
- Follow directions/instructions of AE personnel;
- Must ensure the student attends the Course in an appropriate, private setting;
- Dress appropriately during the Course;
- Adhere to the terms of use of any sites used, including following the specified age policies; and
- Only share material that is related to lessons and appropriate.
II. Age Policy
AE offers Courses for students ages 9 and above. Therefore, students may interact and/or room with a student that is within this age range. Please note the age range of the Course being registered for.
III. Enrolment on the courses
- You are not allowed to share your login details (username and password) with anyone else.
- It is not allowed for registered students to grant access to the portal to non-registered students.
- The AE tuition is provided as group tutoring. There has to be a minimum number of students for this tutoring to progress. The Institute reserves the right to cancel courses if there are not enough enrolled students
- Be allowed to access only those courses for which you enrol through the portal
- Scholarships are restricted to IGCSE, IB MYP, A-Levels and IB Diploma.
- A minimum number of students: AE operates with a minimum number of students. It would also impose a restriction on the maximum number to allow for better learning.
- Students can enrol for more than one course should they wish to. However, at the time of enrolment, one is allowed to register for one course only. After that, they visit the respective course domain and enrol for the desired course. For example; an A-level or IB Diploma applicant can enrol for SAT or any other course at AE by signing up to that course site.
IV. Group Classes
- It is the responsibility of every student to attend the live lessons.
- Missed classes will be forfeited and cannot be made up or refunded.
- Missed lessons will not be re-taken. However, students will get classroom notes and they can ask for any help through email.
- If for any technical fault, we fail to provide the lecture, we will reschedule it for another suitable time.
- Fees for Group Classes are non-refundable and non-transferable.
- Only students registered for the class may participate.
- Classes are only available for subjects set out by AE.
- Classes will only be taught in English.
- AE has the right to refuse service.
- Small-Group Classes are a guidance/tutoring service only. No specific outcomes are promised or guaranteed. AE is not responsible for any specific outcome or lack thereof.
- If you select to make payments, payments will be due as set out during checkout and as listed in your My Account. Please Note: If you have students in Small-Group Classes on different days, payments will be collected separately as payment due dates are based on the start day of the class. By selecting the payment option, you are authorizing AE to auto-charge your card on file for the amounts due per your payment schedule. If for any reason a payment is not made by the due date, you will have 5 business days from the due date to bring the account current, or your student access will be removed from the course until the account is brought current, and you may be charged a £25 late fee. No refunds, credits, or make-up classes will be provided if a session is missed due to delinquent payment.
V. Private and On-demand lessons
- Once made, payment of fees will not be refunded.
- Students have to be flexible with timings with our available tutors. We tend to offer you suitable times but it all depends on the available time slots.
- Students who are not satisfied with the first lecture and have more lectures booked can claim a refund before the next lecture.
- Upon successful payment, you will be provided with a new set of lessons equal to the initial amount purchased. Lessons may be cancelled, through mutual agreement, via email.
- Fees for Online Private Lessons are non-refundable (if booked and the student is absent for any reason). Private Lessons are non-transferable. Lessons not used by the expiration date are forfeited and cannot be refunded in full or prorated.
- Lessons can be rescheduled for any reason up to 24 hours prior to the scheduled lesson. If the student fails to attend a scheduled lesson, the lesson will be deducted from your available sessions. No changes can be made within 24 hours of the lesson start time. A post-lesson progress report will be sent to your email address on file upon completion of each lesson.
- At thephysicsandmathtutor.com, when more than one student enrolls for a lesson or multiple lessons, they qualify for group discounts. Therefore, if any enrolled student decides to withdraw from one or more lessons booked, the fees are non-refundable. This policy is in place because enrolled students have already benefited from discounted rates based on group and multiple lesson bookings.
- Lessons are only available for subjects set out by AE.
- Lessons will only be taught in English. Only the named student is allowed to attend. The lesson link may not be shared with any other student. In order to share the lesson link with other students, the named student should add more than one users at the time of booking the lesson/s. This will incur extra charges, however, only one student will be signed up for the group. All students that participate in the lesson are bound by these Terms and Conditions including our code of conduct.
- AE has the right to refuse service.
- Lessons are a guidance/tutoring service only. No specific outcomes are promised or guaranteed. AE is not responsible for any specific outcome or lack thereof.
- Once you sign up, the one of our admins or the tutor available to take your request will contact you. Please note that you can request for a specific tutor but it is not guaranteed that any specific tutor will be available to take the lessons.
- AE strives to keep its commitment however, if for any unforeseen or untoward reasons the selected tutor fails to be available, we will provide you with the list of tutors available to continue on the course you enrolled. In such cases student or guardian cannot claim a refund for the lessons delivered or pending.
VI. Payment Policy
- Unless otherwise noted, all financial transactions are made and quoted in GBP Sterling Pounds.
- All fees paid for Online Courses are non-transferable. If AE cancels a Course for any reason, the fees paid for Online Courses, as well as the deposits and other administrative fees paid for In-Person Courses, will remain to be refunded.
- AE has the right to charge a £25 late fee on any payments not paid by the due date and to charge a monthly finance charge on any balances that remain outstanding 30 days after the last day of the Course for which the fee was charged. AE also has the right to send a balance over 30 days past due to a collection agency for collection (collection agency fees may apply).
- All fees (registration, administrative, late, etc.) must be paid prior to the start of a Course unless a payment plan has been agreed to. Students will be withdrawn from a Course if the Course has not been paid in full prior to the start of the Course, or if at any time a payment is not paid by the due date. No refunds, credits, or make-up classes will be provided if a session is missed due to delinquent payment. Specific information on payment plans provided for each Course can be found on the AE Website.
- By agreeing to a subscription or payment plan, you are authorizing AE to auto-charge the credit card on file as agreed at the time of purchase.
- A £25 fee will be assessed for any card transactions that are not honoured.
- Students are entitled to a full money-back guarantee if they wish during a cooling-off period of 14 days only for the group tutoring programmes. After 14 days and up to 28 days, they will be entitled to vouchers to be used in the future for the same or alternate courses.
- Those enrolling for instalments plans agree that subsequent payments will automatically be charged to the card registered at the shopping cart during registration.
- Once a course code has been chosen, AE cannot guarantee that you will be able to switch over to another course, as this will depend on if the other group has any students or if there are any seats available on the course. The applicant is liable to pay the fee on the same course he/she enrolled in.
- If a course is transferred a sign-up is required on the respective subdomain or other domain powered by AE and depending on the cooling period one may be given the vouchers to cash. However, if there is a possibility to cash the vouchers it will only be allowed once.
VII. General
- Due to the nature of the online tuition, we regret that AE does not provide any practical or laboratory work assistance or guidance in science courses. Only theoretical content is taught.
- Following the completion of tuition, the student will be awarded a certificate of completion for attending AE for tuition classes (applicable for only Short Courses programmes).
- Those awarded scholarships will be sent a letter that informs them of this, which may be used by students in their CVs.
VIII. Reservation Changes
To provide outstanding Courses, we may have to limit your ability to make changes (such as registering for a different course or changing attendance dates) and/or cancel a Course. Please reference the Terms and Conditions for a specific Course (linked above) for the rules and restrictions for changes and cancellations for that Course.
IX. Scholarships
- Enrolling in a course is not a guarantee of a scholarship
- The student must attend the appointed interview and email the required documents. If documents are not emailed with the registration form, then the student will not be invited for a scholarship. It is the responsibility of the student to make sure that s/he has done this process.
- For applicants who chose payment plans, the scholarship amount will be discounted on every instalment paid
- The scholarship is awarded as a reduction in tuition fee; no cash amount or refund of payment is made.
- The scholarship is awarded after the cooling period is over.
X. Promotions and Discounts
Promotional discounts are limited to one discount per student. There may be other limitations as to how they apply, and codes must be submitted at the time of registration or purchase. AE will not honour retroactive adjustments, and the total discounts received cannot exceed the total cost of the products purchased.
The Refer-a-Friend Code is an incentive programme that allows people to be rewarded for referring others to AE.
- Every time you refer someone, who proceeds to register and purchase a course, you will be rewarded with a refund.
- The voucher will be awarded to the referrer after a successful purchase has been made, and the refund period has lapsed.
- Students may refer other students to qualify for the voucher.
- Each voucher will have an expiry date and should be used prior to this date lapsing.
XI. Certificates/Vouchers
All sponsorships/vouchers are non-refundable, non-transferable, and not redeemable for cash. Certificates/vouchers must be redeemed at the time of registration. Certificates/vouchers are valid until the specified expiration date, without exception. They are valid for up to the amount issued, and any amounts not used are forfeited.
XII. General Releases
- Media Release: As a condition of participation, you authorize AE and its partners to take photos, videos, images, audio, and testimonials of you and your student and agree that said content may be used by AE in promotional materials, marketing collateral and online media. These images, testimonials, photos, videos, and audio may be shared and used by corporate partners, the media, or other organisations that work with AE. You also agree that all projects and work created by your student during an AE Course may be used by AE in promotional materials, online, and other print media, and may be shared and used by corporate partners, the media, or other organisations that work with AE. You understand that AE, its owners, agents, partners, facility providers, and employees will not be held liable for damages and injuries associated with the use of any content released herein, including any and all claims based on negligence. You agree that all images, testimonials, photos, video, and audio taken at or in connection with an AE Course are the sole and exclusive property of AE and that AE has a royalty-free, perpetual license to use copies of all student work and projects created at an AE Course.
- Name and Likeness Release: As a condition of participation, you authorize AE and the press to use your student’s full name and likeness in print, radio, TV, and other mediums.
XIII. Indemnification
You agree to defend, indemnify, and hold AE, its officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorneys’ fees and costs, arising out of or in any way connected with your student’s participation in a AE Course.
XIV. Arbitration Agreement
You agree that any dispute other than collection matters, arising out of or relating to this Agreement, you or your student’s participation in a Course with AE, or otherwise arising between the parties, including, without limitation, any statutorily created or protected rights, as permitted by applicable laws, shall be settled by arbitration to be held in England, the United Kingdom, in accordance with the UK Arbitration Act, and judgment upon the award rendered by the arbitrator(s) may be entered in any court of competent jurisdiction. The prevailing party in the arbitration shall be entitled to recover expenses including costs and reasonable attorney’s fees associated therewith. Should any part of this contract be found invalid or not enforceable by a court of law, then the remaining portion shall continue to be valid and in force. You hereby acknowledge that you understand the terms of this ARBITRATION AGREEMENT, and you agree to comply with all of its terms and provisions.
XV. Rights Reserved
AE reserves the right to update or modify these Terms and Conditions at any time. AE is not a university-sponsored Institute. AE reserves the right to cancel or modify any and all classes, lessons or courses for any reason.
XVI. Release of Liability
ON BEHALF OF MY SON/DAUGHTER/WARD, I, THE PARENT/GUARDIAN, IN EXCHANGE FOR THE RIGHT OF MY SON/DAUGHTER/WARD TO PARTICIPATE IN AE COURSE(S), HEREBY RELEASE AE, ITS DIRECTORS, AGENTS, PARTNERS, FACILITY PROVIDERS AND EMPLOYEES FROM LIABILITY (INCLUDING CLAIMS BASED UPON NEGLIGENCE) FOR ANY AND ALL DAMAGES OR INJURIES TO MY SON/DAUGHTER/WARD OR DAMAGE OF ANY PERSONAL PROPERTY. I AGREE TO BE FULLY RESPONSIBLE FOR ANY AND ALL SUCH DAMAGES OR INJURIES WHICH MAY RESULT DIRECTLY OR INDIRECTLY FROM ANY NEGLIGENT ACTS OR ACTIVITIES ASSOCIATED WITH AE HOWEVER, I UNDERSTAND THAT I AM NOT RELEASING AE, ITS OWNERS, AGENTS, PARTNERS, FACILITY PROVIDERS, AND EMPLOYEES FROM GROSS NEGLIGENCE, RECKLESS CONDUCT OR INTENTIONALLY TORTIOUS CONDUCT. TO THE EXTENT THIS RELEASE CONFLICTS WITH STATE/PROVINCIAL LAW GOVERNING RELEASES, THIS RELEASE IS TO BE GIVEN THE FULLEST FORCE AND EFFECT PERMITTED UNDER STATE/PROVINCIAL LAW. SHOULD ANY PART OF THIS CONTRACT BE FOUND INVALID OR NOT ENFORCEABLE BY A COURT OF LAW, THEN THE REMAINING PORTION SHALL CONTINUE TO BE VALID AND IN FORCE.
XVII. Copyright
Due to copyright rules, students are not permitted to share the portal questions with others, without explicit written permission. In addition, they are not allowed to share lectures, lecture notes, study material and portal questions.
